Terms of Service

In short: nodan.net hosts your static website or WordPress site for a monthly or yearly fee. You keep ownership of your content and are responsible for it. Do not use the service for anything illegal or harmful. You can cancel at any time.

These terms apply to the hosting services, the customer portal at portal.nodan.net and the optional setup service offered by nodan.net, which is operated by Alex Hawkins, an individual based in Florida, USA ("we", "us"). By requesting an account or using the services, you agree to these terms. If you use the services for a business, you agree to them on behalf of that business.

1. Your account

  • You must be at least 18 years old to have an account. We review every account request and may decline one.
  • You sign in with links sent to your email address. Keep access to that email account secure: anyone who can read it can sign in to your account.
  • Give us accurate contact details and keep them up to date. We send important notices about your account and payments to your email address.

2. The hosting services

  • Static websites: we publish the files you upload or deploy from a Git repository. We keep earlier versions of your site so you can restore them, and may delete older versions after a while.
  • Managed WordPress: we run WordPress for you in its own isolated environment, make backups and apply managed updates. Plugins, themes and content you add, and the changes you make in WordPress, are your responsibility.
  • We aim to keep the services available at all times but do not guarantee uninterrupted operation. Maintenance, failures and events outside our control can cause interruptions.
  • Each plan has the limits shown when you choose it and in the portal (for example the number of sites and the resources each site can use). We may change the services, including adding or removing features, as long as this does not substantially reduce what you paid for.

3. Your content

  • You keep all rights to the content you put on the services: files, text, images, data and your domain names. You give us permission to store, copy, process and serve that content only as needed to run the services for you.
  • You are responsible for your content and for having the rights to publish it, and for complying with the laws that apply to your website, including privacy laws towards your own visitors.
  • We make backups of WordPress sites, and keep earlier versions of static sites, but you should keep your own copy of your website and its content. We are not responsible for lost content.

4. Acceptable use

You may not use the services, or let others use your sites, to:

  • break the law, or host content that is illegal, infringes others' rights (such as copyright or trademarks), or exploits or harms children;
  • distribute malware, phishing pages, or content designed to deceive people into giving up passwords, payment details or other personal information;
  • send spam or host content for unsolicited bulk messages;
  • harass, threaten or incite violence against others;
  • attack, probe or overload other systems or networks, including ours, or mine cryptocurrency;
  • try to get around the limits or isolation of the services or access other customers' data.

If we find a site that breaks these rules, or receive a credible complaint, we may disable the site or the affected part of it. We tell you why unless the law or the urgency of the situation prevents it, and give you a chance to fix the problem where possible.

5. Fees and payment

  • Plans are billed monthly or yearly in advance, in US dollars, and renew automatically until you cancel. Prices are shown on nodan.net and in the portal. Sales tax is added where it applies.
  • Payments are processed by Stripe. You can change your payment method, see your invoices and cancel under "Manage billing" in the portal.
  • When you change to another plan, the difference is charged or credited right away.
  • If a payment fails, we and Stripe will try again and let you know. If the payment remains unpaid, we may suspend your sites after giving you notice.
  • We may change our prices. A new price applies to your plan from your next renewal at least 30 days after we have told you about it.
  • Cancellations and refunds are described in our Refund Policy.

6. Setup service

  • The optional setup service is a one-time fee for which we set up one of your sites using the information and logo you send us with the setup form, such as your business details, contact details and opening hours.
  • You are responsible for the information you send us being accurate, and for having the right to use the logo and any other material you provide.
  • We tell you when your site is set up. If something is not as you asked, let us know within 14 days and we will correct it. Changes beyond what you originally asked for are not included.
  • After the setup, the site is yours to maintain like any other site on your plan. The setup service does not include a hosting plan.

7. Cancellation and termination

  • You can cancel your plan at any time under "Manage billing". Your plan stays active until the end of the period you paid for.
  • To close your account and have your sites and data deleted, email support@nodan.net. Before you do, download a copy of anything you want to keep.
  • We may suspend or close an account that seriously or repeatedly breaks these terms, or that stays unpaid after notice. If we stop offering the services altogether, we will give you at least 30 days' notice and refund any prepaid time you have not used.

8. Domains and DNS

You remain the owner of your domain names and are responsible for registering and renewing them. If you connect your Cloudflare account, we only create, change or delete the DNS records needed for the domains you add to your sites, and only after you ask us to. Removing a domain from a site does not delete its DNS records unless you choose that.

9. Disclaimers

The services are provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.

10. Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data, arising from your use of the services. Our total liability for any claim relating to the services is limited to the amount you paid us in the 12 months before the claim arose.

11. Indemnity

You agree to compensate us for claims, damages and costs (including reasonable legal fees) brought by others because of your content or your breach of these terms.

12. Governing law

These terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-law rules. Any dispute relating to the services will be brought in the state or federal courts located in Florida, unless the law where you live gives you the right to bring it elsewhere. Before going to court, please email us so we can try to resolve the issue informally.

13. Changes to these terms

We may update these terms. If we make significant changes, we will tell you by email or in the portal at least 30 days before they take effect. If you continue to use the services after that, the new terms apply; if you do not agree, you can cancel your plan.
